There are few experts in retail loss prevention who possess Mr. Murphy’s retail background. He has managed both field and corporate loss prevention departments for Fortune 500 retailers. This entailed the development and execution of policies, procedures and training of thousands of retail associates.
The primary areas that both plaintiff and defense counsel seek are related to
- Shoplifting false arrest
- Serious injury and death cases (shoplifter or customer) resulting from the actions of retail loss prevention associates
- Serious injury and death cases due to violent crime.
- And, unfortunately, the sexual assault of customers by loss prevention personnel.
Major retailers (including grocery), in general, have excellent policy and procedures. The problems begin at the points of hiring, training and supervision. There is not a standard for retail loss prevention/asset protection because each has different risks. The security related issues may be similar, the approach that varies.
Mr. Murphy has a wealth of experience in managing and developing loss prevention programs. He also has provided consulting for companies to help strengthen or develop their LP programs.
In litigation he is a court-qualified expert witness in Walmart Asset Protection and their AP-09 policies. Walmart cases are especially challenging in the discovery phase and attorneys need insight into all aspects of their 4 week training program and policies. (See our $16.9M jury verdict)
Mr. Murphy has provided litigation support in plaintiff and defense cases for:
- Wal Mart

Some defense cases involve “hidden cameras” in restrooms/fitting rooms.
